Welcome to Lush Emporiums. In these terms, "we," "us," and "our" refer to Lush Emporiums. We operate this online store and website, including all related content, features, tools, products, and services, to give you a curated shopping experience (the "Services"). Our store runs on Shopify, which helps us deliver these Services to you.

We work hard to represent our products and services accurately throughout the store. That said, colors and appearance may look different from one screen to another depending on your device and its settings.

We can't guarantee that the look or quality of any product or service you buy will match your expectations or appear exactly as shown online.

Product descriptions may change at any time, at our discretion and without notice. We may also discontinue any product at any time and limit the quantities we sell to any person, region, or jurisdiction on a case-by-case basis.

Placing an order is an offer to buy. Lush Emporiums may accept or decline any order at its discretion, and your order isn't accepted until we confirm it. We need to receive and process your payment before accepting an order. Please double-check your order before submitting it, since we may not be able to make changes once it's accepted. If we decline, change, or cancel an order, we'll try to reach you using the email, billing address, or phone number provided at checkout.

You confirm that your purchases are for personal or household use, not for commercial resale or export.

Section 4 — Pricing and Billing

Prices, discounts, and promotions can change without notice. The price you pay is the one in effect when you place your order, as shown in your order confirmation email. Unless stated otherwise, posted prices don't include taxes, shipping, handling, customs, or import fees.

Prices online may differ from those in physical locations or in stores run by third parties. From time to time we may run promotions with their own terms; if those terms conflict with these Terms, the promotion's terms apply.

You agree to keep your purchase, payment, and account information accurate and up to date — including your email address and card number and expiration date — so we can complete your orders and reach you when needed.

You confirm that (i) the payment details you provide are true and complete, (ii) you're authorized to use the payment method, (iii) your card issuer will honor the charges, and (iv) you'll pay the posted prices, including shipping, handling, and any applicable taxes.

Section 5 — Shipping and Delivery

We aren't responsible for shipping or delivery delays. All delivery times are estimates and aren't guaranteed. We aren't liable for delays caused by carriers, customs, or other events beyond our control. Once we hand products to the carrier, title and risk of loss pass to you.

Section 6 — Intellectual Property

The Services — including all trademarks, brand elements, text, layouts, images, graphics, reviews, video, and audio, along with their design, selection, and arrangement — are owned by Lush Emporiums, its affiliates, or its licensors, and are protected by U.S. and international intellectual property laws.

These Terms let you use the Services for personal, non-commercial purposes only. Without our prior written permission, you may not copy, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any of the material on the Services. Except where expressly stated here, nothing in these Terms grants you any license or rights under any patent, trademark, copyright, or other intellectual property of Lush Emporiums, Shopify, or any third party. Unauthorized use may violate intellectual property laws. All rights not expressly granted are reserved.

The Lush Emporiums name, logo, and related product and service names, designs, and slogans are trademarks of Lush Emporiums or its affiliates or licensors, and you may not use them without our written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other marks on the Services belong to their respective owners.

Section 7 — Optional Tools

The Services may give you access to third-party customer tools that we don't monitor or control.

You agree that we provide these tools "as is" and "as available," with no warranties, representations, or endorsements of any kind, and that we have no liability arising from your use of them. Using any optional third-party tool is entirely at your own risk, and you should review and accept the relevant provider's terms first.

We may also add new features or tools in the future. Any such additions are considered part of the Services and are covered by these Terms.

Section 8 — Third-Party Links

The Services may include content and links to websites operated by third parties, including embedded third-party functionality. We aren't responsible for reviewing or evaluating the content or accuracy of those materials or sites. If you leave the Services to visit them, you do so at your own risk.

Lush Emporiums is powered by Shopify, which enables us to provide the Services. Even so, any purchases you make in our store are made directly with Lush Emporiums. By using the Services, you agree that Shopify isn't responsible for any part of a sale between you and Lush Emporiums, including any injury, damage, or loss tied to the products or services you buy. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with Lush Emporiums.

We may — but don't have to — monitor, edit, or remove any Feedback we consider, at our discretion, unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes anyone's rights or these Terms.

You agree your Feedback won't violate any third party's rights, including copyright, trademark, privacy, or other rights, and won't be libelous, abusive, obscene, or contain viruses or malware that could affect the Services. You may not use a false email address, impersonate anyone, or otherwise mislead us about the origin of Feedback. You're solely responsible for your Feedback and its accuracy, and we assume no liability for Feedback posted by you or others.

Section 12 — Errors, Inaccuracies, and Omissions

Occasionally, content on the Services may contain typos, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change information or cancel orders when information is inaccurate, at any time and without prior notice — including after you've placed an order.

You also agree not to: (a) upload viruses or malicious code that could affect the Services; (b) reproduce, copy, sell, resell, or exploit any part of the Services; (c) collect or track others' personal information; (d) spam, phish, pharm, spider, crawl, or scrape; or (e) interfere with or bypass the security features of the Services or any related site or network. We may suspend, disable, or terminate your account at any time, without notice, if we believe you've violated any part of these Terms.

We may end this agreement or your access to the Services (or any part of them) at our discretion, at any time and without notice, and you'll remain responsible for any amounts owed through the termination date.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should continue.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DON'T ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUSH EMPORIUMS AND OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AND THOSE OF SHOPIFY AND ITS AFFILIATES — WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT OBTAINED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 17 — Indemnification

You agree to indemnify, defend, and hold harmless Lush Emporiums, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — payable to a third party and arising from (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.

We'll notify you of any claim subject to indemnification, though a delay in notice won't relieve your obligations unless it materially prejudices you. We may control the defense and settlement of such a claim at your expense, including choice of counsel, but won't settle any claim that imposes non-monetary obligations on you without your consent (not to be unreasonably withheld). You agree to cooperate in the defense, including by providing relevant documents.

If any provision of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. This won't affect the validity or enforceability of the remaining provisions.

Section 19 — Waiver and Entire Agreement

If we don't exercise or enforce any right or provision of these Terms, that's not a waiver of that right or provision.

These Terms, along with any policies or operating rules we post regarding the Services, make up the entire agreement between you and us and govern your use of the Services, replacing any earlier agreements or communications, whether written or oral, including any prior versions of these Terms. Any ambiguity in interpreting these Terms won't be construed against the party that drafted them.

Section 20 — Assignment

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice.

Section 21 — Governing Law

These Terms, and any separate agreements under which we provide the Services, are governed by and interpreted in line with the laws applicable in the jurisdiction where Lush Emporiums is based, and you and Lush Emporiums consent to the venue and personal jurisdiction of the courts there.

The headings in this agreement are for convenience only and don't limit or affect these Terms.

Section 23 — Changes to These Terms

You can review the current version of these Terms on this page at any time. We may update, change, or replace any part of them at our discretion by posting the revised version to our website, and it's your responsibility to check back periodically. We'll provide notice of material changes as required by law, and those changes take effect on the date stated in the notice. Continuing to use the Services after changes are posted means you accept them.
